An article by Nuno Serrão Faria, a trainee lawyer at PLMJ, has been published under the title “Access to Wire-tapping Records – The Powers of Destruction of the Investigating Judge”, which is one of nine studies included in the work “Criminal Evidence and the Right to Defence – Studies on the Theory of Evidence and Defence Guarantees in Criminal Proceedings”, published by Almedina.
This work brings together a set of papers on the problems of evidence and of understanding the defence guarantees in criminal proceedings. It covers a number of themes including the re-enactment of the crime, the framework for the first judicial examination of a person of interest who has been arrested, the right to silence and the right against self incrimination, the gathering of evidence by undercover agents, home searches, the lack of possibility of appeal against the judge’s decision on whether or not a prosecution should proceed, wire-tapping records or the rules on inadmissible evidence and their effect from a distance.
