The European Union held that charging tolls on the form SCUT (virtual toll road concessions) was illegal and recommended Portugal not to change the rules in place for those roads. Ricardo Oliveira, a partner in PLMJ’s EU and competition practice believes that, “the opinion from Brussels should have the same impact on all SCUT roads, because the legislation in question is general in character.”
