Regarding the recent Govern decision to locate the new Lisbon Airport in Alcochete and the consequences of this decision for the concession contract celebrated between the Portuguese Estate and Lusoponte, the Jornal de Negócios heard the opinion of Tiago Duarte, PLMJ Partner and a Public Law Professor at the Nova University of Lisbon.
Tiago Duarte’s declarations were published yesterday, the 16 of January, in an article under the title “The Third (Tagus) Crossing”.
According to Tiago Duarte« The Estate may unilaterally modify the exclusivity clause of the contract celebrated with Lusoponte. Should an agreement with the cessionary fail ,the public interest may be invoked –based upon both the alteration of circumstances determined by the decision to construct the new Lisbon Airport in Alcochete and a new bridge - not only to modify the contract but also the law,should the financial balance be respected .
