Tiago Duarte, PLMJ Partner and a Constitutional Law Professor, commented for the Portuguese television channel “TVl” the Constitutional Court Judgment which declared the inconstitutionality of the Traffic Regulations Code’s disposition which prevented the voluntary payer of a fine to present prove, within the opposition to the accessory sanction forbidding him to drive, that he had not practiced the facts from which the alleged infraction derived.
For the Constitutional Court this prohibition violates the right for the defendant to acced to Justice.
