EU and Competition Law

Back

PLMJ’s European and Competition Law team has extensive experience assisting clients with all matters related to competition law and European Union law, regardless of the complexity or scale of the issue.

Our team also collaborates through PLMJ Colab in the Angolan and Mozambican jurisdictions, providing a broader coverage of cross-border competition issues.

One of our key strengths at PLMJ lies in our smoothly functioning multidisciplinary teams, which enhance our European and Competition law practice by providing added sensitivity in corporate, regulatory and litigation matters. This integrated approach equips us to navigate complex transactional and litigation cases, ensuring that we deliver comprehensive and effective legal solutions to our clients.

The team has participated in high-profile competition law cases for companies spanning various sectors, such as aviation, energy, financial services, food distribution, pharmaceuticals, and telecommunications. Our experience includes handling cases before the Portuguese Competition Authority and the European Commission, as well as representing clients before national and European courts, arbitral tribunals and the European Court of Human Rights.

The team provides legal services in a wide range of areas, such as:

  • Defending companies in cartel, abuse of dominance and abuse of economic dependency cases.
  • Advising companies in civil damages claims matters, whether follow-on or stand-alone.
  • Notifying concentrations before the European Commission or the Portuguese Competition Authority.
  • Assessing contractual clauses.
  • Providing preventive assistance by carrying out audits, training sessions and implementing compliance programmes.
  • Advising both private and public entities on State aid matters.
  • Notifying operations under the Foreign Direct Investment (FDI) rules.
  • Notifying operations under the Foreign Subsidies Regulation (FSR).
  • Providing assistance on  EU funds matters.
  • Advising on matters related to the free movement of goods, persons, services and capital within the EU.
  • Advising on cases before the European Court of Human Rights.

Specialisations

There are several points I would like to highlight: they have been proactive, in that we never need to ask them about the case as they always proactively let us know. Besides the legal knowledge of the field, the team also showed good knowledge of the business side. They did their homework and were quite familiar with us. There are no improvements that I can remember - in every single aspect they have been better than we expected.
